What exactly is legal and not legal?

Edit: just read through the TOS besides the 9999 spelling fails they do basically ban pservers,

But would downloading the unzipped client which saves us from agreeing to the TOS save us from the law?

It doesn't matter. EOSERV does not violate any copyright laws. The players are violating the ToS not the host. EOSERV does not use anything from Endless Online.

The person hosting is only breaking the law by using original maps and pubs so creating your own means they can't do anything. as Scott said, EOSERV is not illigal in anyway due to not including original EO stuff it is just the server package.

The gfx are not on the host, the user wishing to play downloads the client from Endless Online thefore still not illigal as the host isn't hosting the client.

Edit:
EOServ / Seose do not hold anything that belong to Endless Online and thefore unless you, yourself are hosting the original map and pub files then that's the illigal part. It's simple enough to answer and the answer is

Legal
If you have your own (and I mean own) map and pub files

Illigal
If you have the original map and pub files.
